Terms of Service: Website Creation and Design Plans

These Terms of Service (“Terms”) govern the use of our website creation, website hosting, and email hosting services (“Services”). By using our Services, you (“Client,” “you,” or “your”) agree to these Terms. If you do not agree, you may not use our Services.

1. Services Provided

1.1. Website Creation – We design, develop, and deliver websites based on the scope agreed upon with the Client.
1.2. Website Hosting – We provide server space, bandwidth, and resources to host your website.
1.3. Email Hosting – We provide hosted email services, including domain-linked email accounts, subject to mailbox and storage limits as defined in your plan.

2. Client Responsibilities

2.1. Content – You are solely responsible for providing accurate, lawful, and non-infringing content for your website and email accounts.
2.2. Use of Services – You agree not to use our Services for:

  • Illegal activities (e.g., fraud, copyright infringement).
  • Sending spam, phishing, or malicious communications.
  • Hosting or distributing malware.
    2.3. Account Security – You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

3. Payments and Fees

3.1. Pricing – Fees are based on the package selected and are billed monthly or annually.
3.2. Late Payments – Accounts unpaid after 14 days may be suspended or terminated until payment is received.
3.3. Refunds – Payments are non-refundable unless otherwise agreed in writing.

4. Service Availability and Support

4.1. Uptime – We strive for 99.9% uptime but do not guarantee uninterrupted service.
4.2. Maintenance – We may perform scheduled or emergency maintenance, which may temporarily affect service availability.
4.3. Support – Technical support is available via email/phone during normal business hours.

5. Data and Privacy

5.1. Data Ownership – You retain ownership of your website content and email data.
5.2. Backups – We perform regular backups but do not guarantee full restoration in all circumstances. Clients are encouraged to maintain their own backups.
5.3. Privacy – We protect client data in accordance with our Privacy Policy. Email hosting includes encryption at rest and in transit where applicable.

6. Termination

6.1. By Client – You may terminate your Services at any time by providing [30 days] written notice.
6.2. By Provider – We may suspend or terminate Services if you:

  • Breach these Terms.
  • Fail to pay fees when due.
  • Engage in abusive, fraudulent, or unlawful activity.
    6.3. Effect of Termination – Upon termination, access to hosting and email accounts will be disabled. We may delete data after 60 days unless otherwise required by law.

7. Website Build Pricing & Ownership

The discounted website initial build cost related to our website plans is offered exclusively in connection with an active hosting subscription given under the respective hosting plan.

7.1. Failure to Pay – If you cancel hosting early and do not exercise the Early Full Ownership Option (7.3. Item 2), we reserve the right to retain all rights to the website and may disable access.
7.2. Ownership During Commitment Period – The website design, code, and related assets remain the property of River Valley It Solutions LLC until you have maintained a minimum of twelve (12) months of continuous hosting service.
7.3 Early Cancellation – If you cancel hosting before completing twelve (12) months:

  • The website will remain disabled or under our ownership, unless you elect to purchase full ownership through our Early Full Ownership Option.
  • Early Full Ownership Option: you must pay the difference between the Discounted Initial Build Cost and the Standard Build Cost relative to the website creation plan. Once this amount is paid in full, ownership of the website design, code, and assets transfers to you.
  • These static prices related to their respective plans are as follows
    • Starter – Discounted Initial Build Cost = $250 USD | Standard Build Cost = $1250 USD | Early Full Ownership Option Total = $1000 USD
    • Growing Business – Discounted Initial Build Cost = $350 USD | Standard Build Cost = $1850 USD | Early Full Ownership Option Total = $1500 USD
    • Pro – Discounted Initial Build Cost = $550 USD | Standard Build Cost = $2450 USD | Early Full Ownership Option Total = $3000 USD

8. Portfolio & Attribution Rights

8.1. No Claim of Ownership – This right is for promotional purposes only and does not grant us any ownership over your content, branding, or intellectual property.
8.2. Attribution – We reserve the right to include a discreet “Website Created by RVITS.net” attribution in the footer of the website during the hosting period. You may request removal of this attribution in writing.
8.3. Promotional Use – Regardless of ownership or hosting status, we retain the right to use screenshots, the website design, and/or your business name and logo strictly for the purpose of promoting our services, including in our portfolio, the www.rvits.net website, proposals, and social media.

9. Limitation of Liability

9.1. We are not liable for indirect, incidental, or consequential damages, including loss of profits, data, or business opportunities.
9.2. Our total liability for any claim related to the Services is limited to the amount paid by you in the last three (3) months.

10. Indemnification

10.1. You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your use of the Services, violation of these Terms, or infringement of third-party rights.

11. Modifications to Terms

11.1. We may update these Terms at any time by posting the revised version on our website. Continued use of Services after changes constitutes acceptance of the updated Terms.

12. Governing Law

11.1. These Terms are governed by and construed under the laws of Dolphin County, PA, USA. Any disputes will be subject to the exclusive jurisdiction of the courts in Harrisburg, PA, USA.
